ADD FLAVOR! The Jim Beam Gourmet Sweepstakes

DATES OF SWEEPSTAKES: The Jim Beam “Add Flavor” Gourmet Foods Sweepstakes (the “Sweepstakes”) begins at at 12:00 a.m. Eastern Time (ET) on March 1, 2008 and ends at 11:59 p.m. ET on December 31, 2008 (the “Sweepstakes Period”).

ELIGIBILITY: In order to be eligible for entry into the Sweepstakes, you must be: a) a legal permanent United States resident residing in any of the contiguous 48 United States or the District of Columbia, and b) 21 years of age or older with a unique valid Social Security number at the time of entry. Employees and their immediate family members (parents, children, siblings or spouse, regardless of where they live, or persons living in same household, whether related or not) of THANASI Foods LLC, Vita Specialty Foods, Inc. (collectively the “Sponsors”), and its parent companies, divisions, affiliates, contractors, subsidiaries, distributors, sales representatives, retailers, advertising and promotion agencies, and any others engaged in the development, production, execution or distribution of this Sweepstakes, including, but not limited to, the entities supplying the Prizes herein (the “Sweepstakes Entities”), are not eligible to participate. VOID IN PUERTO RICO AND WHEREVER ELSE PROHIBITED.

HOW TO ENTER: Visit www.JIMBEAMFOODS.com/win during the Sweepstakes Period and follow the link to the Sweepstakes Registration Page. Complete and submit the Official Online Entry Form, in its entirety, including your full name, physical address, city, state, zip, phone, e-mail address and date of birth. In order for an online entry to be valid, entrant must have a valid e-mail address and must click the “submit” button. All online entries must be submitted by 11:59 pm ET on December 31, 2008. You must complete the entire registration and configuration process in order to be automatically entered into the Sweepstakes. If you abort the registration and configuration process before it is complete, or if you un-configure before the end of the Sweepstakes, you will not be eligible to win. Limit one (1) entry per person/e-mail address per day for online entries. Neither Sponsors nor any Sweepstakes Entity is responsible for any online entry that is lost, late, misdirected or undeliverable, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise.

The total maximum number of online entries allowed during the Sweepstakes Period per person/e-mail address is 306 entries.

In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet access provider, on-line service provider, or other organization that is responsible for assigning e-mail addresses, or the domain associated with the submitted e-mail address. Potential winners may be required to show proof of being the authorized account holder.

Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, logins, and/or any other methods, including, but not limited to, automated entry, will void that entrant’s entries and that entrant may be disqualified from the Sweepstakes. Neither the Sponsors nor Sweepstakes Administrator will verify receipt of entries for entrants. All entries submitted become the sole property of Sponsor and will not be returned.

DRAWING: On or about January 5, 2009, prize winners will be selected in a random drawing conducted by THANASI Foods, LLC, whose decisions are based on their sole discretion and interpretation of these Official Rules, and are final and binding in all respects. Odds of winning the Sweepstakes depend upon the total number of eligible entries received.

GRAND PRIZE: One (1) Grand Prize (the “Grand Prize Package”) to include the following will be awarded: a) Kalamazoo Gourmet® Free Standing Grill, ARV: $7,500, b) 42” HDTV Flat Panel Plasma TV, ARV: $2,000, c) Year’s supply of Grilling Steaks from winner’s favorite grocer’s butcher Department, ARV: $2,000, d) Year’s supply of Jim Beam Beef Jerky, ARV: $2,186.35, e) Year Supply of Jim Beam Barbeque and Grilling Sauces, ARV: $350, and f) Jim Beam Grilling utensils, ARV: $250. The total Approximate Retail Value (the “ARV”) of the Grand Prize Package is $14,286.35 USD.

FIRST PRIZE: One (1) First Prize (the “First Prize Package”) to include the following will be awarded: a) Weber® Deluxe Free Standing Grill, ARV: $750, b) Year’s supply of Grilling Steaks from winner’s favorite grocer’s butcher Department, ARV: $2,000, c) Year’s supply of Jim Beam Beef Jerky, ARV: $2,186.35, d) Year Supply of Jim Beam Barbeque and Grilling Sauces, ARV: $350, and e) Jim Beam Grilling utensils, ARV: $250. The total Approximate Retail Value (the “ARV”) of the First Prize Package is $5,536.35 USD.

SECOND PRIZE: One (1) Second Prize (the “Second Prize Package”) to include the following will be awarded: a) Weber® Premium Free Standing Grill, ARV: $650, b) Year’s supply of Grilling Steaks from winner’s favorite grocer’s butcher Department, ARV: $2,000, c) Year’s supply of Jim Beam Beef Jerky, ARV: $2,186.35, d) Year Supply of Jim Beam Barbeque and Grilling Sauces, ARV: $350, and e) Jim Beam Grilling utensils, ARV: $250. The total Approximate Retail Value (the “ARV”) of the First Prize Package is $5,436.35 USD.

Total ARV of all Prizes available to be awarded for the entire Sweepstakes is $25,259.05.

PRIZE RESTRICTIONS: The value of the Prizes are taxable as income to the Prize winners. In addition, Prize winners are solely responsible, at his/her own cost, for all matters relating to the Prize, including, but not limited to all applicable federal, state and local taxes any additional expenses not listed herein as related to the acceptance and use of the Prize Packages. No transfer or substitution of Prizes is allowed except at the sole discretion of the Sponsors. Prize winners are required to comply with any and all applicable federal, state and local laws, rules and regulations. Sponsors reserve the right to substitute a prize of equal or greater value if prize becomes unavailable due to reasons beyond the control of the Sponsors.

Sponsors and its agencies make no representation, warranty or guarantee, express or implied, in fact or in law, regarding the products of the manufacturers including but not limited to its quality, merchantability or fitness for the intended purpose; the only representation/warranty/guarantee that may be provided relative to the product, if any, are those of the manufacturer.

Prize winners will be issued an IRS 1099 form for the actual value of the Prize Package for the year in which actual prize value was received.

PRIZE CLAIM: Except where prohibited, potential Prize Winners must sign and return within seven (7) days of being notified, an affidavit of eligibility/liability/publicity release and W-9 form (the “Paperwork”) in order to claim prize. If potential Prize Winner cannot be contacted within seven (7) days from the date of the first attempt to contact him/her or if he/she fails to sign and return the Paperwork within the required time period, potential Prize Winner forfeits their right to the Prize and an alternate entrant will be selected in his/her place at random from among all eligible entries received. Prize Winner consents to use of his/her name, likeness, biographical information, and voice in advertising worldwide without additional compensation (TN residents will not be required to sign a publicity release as a condition of winning a prize).

GENERAL RULES OF PARTICIPATION: By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges, which are final in all respects and not subject to appeal. Sponsors reserve the right to disqualify permanently from this Sweepstakes any entrant they believe has violated these Official Rules. By participating in this Sweepstakes, entrants, and winners release the Sponsors and each and all of the Sweepstakes Entities, from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the Sweepstakes, and/or the receipt or use/misuse of the prizes awarded, including, without limitation, liability for personal injury, death or property damage. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. In the event any portion of this Sweepstakes is compromised by activities beyond the control of the Sponsors which, in the sole opinion of the Sponsors, corrupt or impair the administration, security, fairness or proper play of the Sweepstakes or this Sweepstakes, Sponsors reserve the right at their sole discretion to modify, suspend or terminate the Sweepstakes. Winning a prize constitutes permission for Sponsors and its agencies to use winners' names, addresses (city & state), voices and/or likenesses for purposes of advertising, promotion and publicity, for this Sweepstakes only, without further compensation, unless prohibited by law. Sponsors may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants, Sponsors, or Sweepstakes Entities. If for any reason this Sweepstakes is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes and randomly draw from those entries received up to the cancellation/suspension date to award the Prizes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

LIMITATIONS OF LIABILITY: By participating, entrants agree to release, discharge, indemnify and hold harmless THANASI Foods LLC, Vita Specialty Foods, Inc. , and the Sweepstakes Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims made by winners, entrants, or any other third parties, related in any way to the operation of this Sweepstakes as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes.
